Terms of Service

1. The service
SectAnalyst (“the Service”) provides browser-based structural engineering calculation tools — including moment-curvature analysis, P-M-M interaction diagrams, steel member design checks, frame analysis, and topology optimization — offered by SectAnalyst (“we”, “us”). By creating an account or using the Service you agree to these Terms.
2. Engineering responsibility — read this section carefully
The Service performs numerical calculations from input you supply. It is a computational aid, not an engineering service, and using it does not create an engineer-client relationship of any kind. We are not and cannot be responsible for the accuracy or adequacy of the input you provide, nor do we make any warranty, expressed or implied, with respect to the correctness of any output. Although the Service’s calculation engines are developed and validated with care, no software is or can be certified infallible. The final and only responsibility for any analysis, design, or engineering document prepared with the help of the Service rests with you, and — where required by law — with the licensed professional engineer who reviews, verifies, and seals that work. You agree to independently verify all results before relying on them in any design that affects life safety or property. Accordingly, we disclaim all responsibility in contract, negligence, or other tort for any analysis, design, or engineering document prepared in connection with the use of the Service.
3. Accounts
You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account. Accounts are personal; a subscription covers one named user unless your plan states otherwise.
4. Subscriptions and billing
Paid plans are billed in advance, monthly or yearly, through our payment processor (Stripe). Prices are shown at checkout. Plans renew automatically until cancelled; you can cancel any time from the billing portal, and access continues to the end of the paid period. Refunds: [DRAFT — define refund policy with counsel; e.g. 14-day money-back on first purchase]. We may change prices with at least 30 days’ notice, effective at your next renewal.
5. Acceptable use
You may not: attempt to circumvent usage limits, rate limits, or plan entitlements; probe, disrupt, or overload the Service; share account access to avoid purchasing seats; reverse-engineer or scrape the calculation engines; or use the Service to violate any law. API keys are confidential and may not be published or shared outside your organization.
6. Your content
Projects, models, and inputs you save remain yours. You grant us the limited rights needed to store, process, and display them back to you, and to operate features you invoke (for example, sharing a project with another account). We do not use your project data to train models or for any purpose other than operating the Service.
7. Availability and changes
The Service is provided “as is” and “as available.” We may modify, add, or retire features. We aim for high availability but do not guarantee uninterrupted service. We may suspend accounts that breach these Terms.
8. Limitation of liability
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, special, consequential, or exemplary damages, including lost profits, lost data, or the cost of substitute services — and, for the avoidance of doubt and consistent with Section 2, we are not liable for the consequences of any engineering design decision informed by the Service’s output.
9. Termination
You may delete your account at any time. On deletion, your data is removed as described in the Privacy Policy. We may terminate or suspend accounts for breach of these Terms, with notice where practicable.
10. Governing law and disputes

11. Changes to these Terms
We may update these Terms; material changes will be announced in the app or by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
